STRATEGIC OUTCOME:
This action supports the City's Safe and Prosperous and Respected and Responsible strategic outcomes by ensuring fire prevention activities are performed under the most current and appropriate statutory authority while maintaining efficient and effective fire code enforcement throughout the City.
REPORT:
The City of Yuma Fire Department has historically performed certain fire prevention activities on behalf of the Arizona Office of the State Fire Marshal (OSFM) through a Letter of Appointment (LOA). In 2018, the OSFM terminated all existing statewide Letters of Appointment and Memoranda of Understanding in order to standardize its delegation program. In 2019, City Council adopted Resolution No. R2019-007 authorizing the City to enter into the current Letter of Appointment, which was subsequently updated in 2023 to reflect current personnel.
Recent changes to Arizona law enacted through House Bill 2324 provide an alternative mechanism for local jurisdictions to perform inspections of county-owned buildings. The legislation authorizes the Office of the State Fire Marshal, upon joint petition by a city or town and the county in which it is located, to enter into an Intergovernmental Agreement allowing the local jurisdiction to inspect county-owned buildings using the city or town’s adopted fire code.
Termination of the current Letter of Appointment will not affect the City's separate Intergovernmental Agreement with the Office of the State Fire Marshal for public school inspections. Should Yuma County desire to pursue an Intergovernmental Agreement under the new statutory authority in the future, the City of Yuma Fire Department, subject to City Council approval, would support such an agreement.
Staff recommends approving the resolution terminating the current Letter of Appointment.

FISCAL IMPACT STATEMENT:
There is no fiscal impact associated with this action. Termination of the Letter of Appointment does not require additional staffing or expenditure and does not affect the Fire Department's existing operating budget.
