STRATEGIC OUTCOME:
This addendum will allow for a reduction of the Fire Separation of Structures where a one-hour fire wall is constructed. This addendum supports the City Council’s strategic outcomes of Safe and Prosperous and Active and Appealing by allowing alternative placement of new units and awnings while meeting fire safety requirements.
REPORT:
The City Council, by Resolution R2014-11, approved the Development and Deferral of Development Fees Agreement with the Carefree Village Resort, LLC (Agreement). The Agreement details specific costs and fees, placement standards for new units, including fire separation of structures for habitable and non-habitable structures and the deferral of development fees. Section 3 of the Agreement notes the fire separation of structures but does not list when one-hour fire rated construction has been included in a habitable structure.
Carefree Village Resort, LLC (Owner) is seeking to amend the Agreement to allow for a reduced Fire Separation to six feet when a habitable structure was constructed with a one-hour fire wall rating. The reduced fire separation will allow greater flexibility in the size and placement of awnings and structures but still meet fire safety requirements. This amendment will allow Carefree Village Resort to better respond to their residents’ needs for awnings with sufficient width for shade and enjoyment of their spaces as the placement of 12-foot-wide awnings will be allowed where the current maximum is 10-feet wide.
As illustrated in the exhibit to the resolution, the amendment identifies the minimum separation between a habitable structure with a one-hour fire rated wall construction and a neighboring awning as six feet. Additionally, the exhibit identifies the minimum separation between two habitable structures with both having one-hour fire rated construction at six feet should the need arise for this type of placement.
