STRATEGIC OUTCOME:

Approval of this License Agreement supports the City Council’s strategic outcomes of Connected and Engaged and Safe and Prosperous.

The agreement supports Connected and Engaged by continuing the City’s longstanding partnership and coordination with Marine Corps Air Station (MCAS) Yuma and the United States Department of the Navy. The agreement establishes a formal framework for communication and coordination between the City and military personnel before and during each training operation.

The agreement also supports Safe and Prosperous by supporting MCAS Yuma’s military training mission while establishing requirements intended to protect City property and the surrounding community. These provisions include advance notification, site inspections, operational coordination, emergency response planning, environmental safeguards, and restoration of the property following each training event.

REPORT:

The United States Department of the Navy, in coordination with Marine Corps Air Station Yuma and Marine Aviation Weapons and Tactics Squadron One (MAWTS-1), has requested continued use of Kiwanis Park as a training location in support of the semi-annual Weapons and Tactics Instructor (WTI) Course.

The proposed License Agreement provides the Department of the Navy a non-exclusive right to conduct training operations on or near Kiwanis Park, located at 885 S. Magnolia Avenue. The park will be utilized as an urban training environment to support air-ground training operations associated with multiple military aircraft landings and the subsequent ground movement of cargo. Any other use or activity on the property requires prior approval from the City.

The agreement establishes a five-year term and requires the Department of the Navy to provide the City with at least 30 days’ written notice prior to each use of the property, including the anticipated date, time, and duration of the training operation.

MCAS Yuma and MAWTS-1 will coordinate with the City prior to each training operation regarding necessary preparations and the scope of activities. The agreement places a strong emphasis on safety and requires MAWTS-1 to coordinate with local medical and emergency facilities in the event of an aircraft-related incident. Environmental protection measures, including spill prevention and hazardous waste response procedures, are also required during training operations.

Prior to use of the property, representatives of MCAS Yuma and MAWTS-1 will conduct a site survey and inspection to document the general condition of the property. Following each training event, the Department of the Navy will make a reasonable effort to return the property to its condition at the time it took possession.

There is no direct cost to the City associated with the training operations. The City is not requesting compensation for use of Kiwanis Park, and the Department of the Navy is responsible for all costs associated with planning, staffing, equipment, scheduling, management, and execution of the training activities.

Either party may terminate the License Agreement at any time and for any reason by providing 30 days’ written notice. The City also retains the ability to require the immediate termination of an active training operation when necessary.
