Authorize a five-year agreement with Caballeros de Yuma, Inc. for the continued partnership, coordination, and support of community events held at City facilities. (Administration) (Simonton)

STRATEGIC OUTCOME:
This agreement supports the City Council’s Active and Appealing strategic outcome by supporting community events, recreational activities, and partnerships that enhance quality of life and encourage residents and visitors to experience Yuma’s amenities and community offerings.
REPORT:
The City of Yuma and Caballeros de Yuma, Inc. have a longstanding partnership supporting events and activities that provide community and economic benefits and promote Yuma regionally and nationally.
The proposed agreement continues this partnership and establishes the responsibilities of both parties related to the use of City facilities, event coordination, sponsorship, facility maintenance, insurance, and other operational requirements.
Under the agreement, Caballeros de Yuma will continue to produce several major community events, including Midnight at the Oasis, the Colorado River Crossing Balloon Festival, Holiday Pageant & Tower Lighting, Bull of the Desert Strongman Competition, Territorial Marathon, and the Independence Day Flag Raising & Flag Retirement Ceremony.
The City will provide specified City facilities for these events without facility rental or catering fees. These facilities include the Ray Kroc Complex, Main Street West Wetlands Park, Pacific Avenue Athletic Complex, Yuma City Water Tower, Friendship Park, Armed Forces Park, and Yuma Civic Center.
Caballeros de Yuma will continue to recognize the City as a sponsor of Midnight at the Oasis, Holiday Pageant & Tower Lighting, Independence Day Flag Retirement & Flag Raising Ceremony, and the Colorado River Crossing Balloon Festival.
The agreement also continues Caballeros de Yuma's commitment to partner with the City on community betterment efforts. Caballeros will provide at least $60,000 annually to support efforts that may include youth activities, improvements to City facilities and parks, City-sponsored community events, public safety needs, and community and nonprofit organizations. Caballeros will provide the City with an annual report documenting these contributions.
The agreement establishes requirements for event applications and scheduling, cleanup and maintenance, facility condition reports, concessions and alcoholic beverage service, insurance and indemnification, and the use and storage of Caballeros equipment on City property.
The initial term of the agreement is five years, with an automatic renewal for an additional five-year period unless either party provides the required notice. The City retains the right to terminate the agreement at any time with 90 days written notice.

FISCAL IMPACT STATEMENT:
The agreement provides for the waiver of facility rental and certain related fees for specified Caballeros events. City resources provided under the agreement are subject to annual appropriation through the City's budget process.
Caballeros de Yuma will continue to provide at least $60,000 annually toward community betterment efforts in coordination with the City.
