Text Amendment: Construction Debris
end
SUMMARY RECOMMENDATION:
Summary Recommendation
Amend Title 15, Chapter 150 to update regulations related to construction debris. (Community Development/Building Safety) (Randy Crist)
end
STRATEGIC OUTCOME:
The proposed amendment supports the City Council’s strategic outcomes of Active and Appealing and Safe and Prosperous by establishing clearer standards for the containment and removal of construction debris, reducing windblown debris and its impact on neighboring properties and public rights-of-way, while promoting cleaner and safer construction sites for construction and inspection personnel.
REPORT:
This proposed amendment will require construction sites to be kept reasonably clean and construction debris to remain on the lot so it is not displaced by wind onto adjacent properties or City rights-of-way.
The proposed amendment was prompted by multiple complaints involving construction debris, primarily in new residential subdivisions and, to a lesser extent, at infill lots throughout the City. In these cases, debris was not being adequately contained or removed, resulting in materials being blown onto neighboring properties and surrounding areas.
The proposed text amendment was presented to the Residential Building Advisory Board at two separate meetings. The first meeting was conducted as an open discussion to obtain the Board's perspective on the proposed construction-debris requirements. The discussion included conditions and recurring issues observed at construction sites throughout Yuma, as well as consideration of how the proposed requirements could affect builders, developers, and the broader construction community. The Board considered the information and comments presented by staff and provided additional comments and observations based on its members' experience. That feedback was evaluated by staff and incorporated into the proposed amendment where appropriate. The revised text amendment was then returned to the Board at a second meeting for formal consideration and a recommendation. After reviewing the proposed language, the Board voted unanimously, 7-0, to recommend approval of the amendment and noted the positive effect that improved construction-debris containment could have on construction sites, neighboring properties, and the community as a whole.
The amendment would require an approved waste container to be in place before vertical construction begins and remain onsite until final inspection. One container may serve up to two contiguous lots under construction; stand-alone lots must have their own container. Containers must be serviced as often as necessary to prevent overflow, unsafe conditions, or windblown debris. The builder or developer having control over the work is responsible for compliance.
The amendment establishes a clear and consistent standard for construction-debris containment while protecting neighboring properties and City rights-of-way and promoting cleaner, safer construction sites. The Building Official would retain existing authority to withhold inspections and/or assess fees when a site is not in compliance or debris presents a safety hazard.
