SUMMARY RECOMMENDATION: Summary Recommendation
Appoint Richard W. Files as City Attorney under the amended City Charter, Article III, section 3(c), and authorize an agreement with terms of employment.

STRATEGIC OUTCOME:
Appointment of the City Attorney aligns with the City Council’s strategic outcome of Respected and Responsible and ensures authority for the City Attorney to represent the City in all legal proceedings, and perform all other duties prescribed by the City Charter, law, or ordinance.
REPORT:
Following the Special Election of November 7, 2023, the City Attorney serves at the pleasure of the Mayor and City Council and is appointed by the Mayor and City Council as the chief legal advisor to the City Council, the City Administrator, and all City departments, offices, and agencies. This motion appoints Richard W. Files, the current City Attorney, and approves the terms of the City Attorney’s Employment Agreement on file with the City Clerk’s Office.

FISCAL IMPACT STATEMENT:
The City Attorney’s base salary will remain the same and is included in the FY 2024 budget. FY 2024 amounts for car allowance and 457 plan will be paid through the departmental budget.
